Trump Executive Order Promises Better Care To Veterans

Veterans transitioning back to civilian life can look forward to expanded mental health services, more choices for accessing care under some circumstances and other expanded assistance and support transitioning to civilian life under the Presidential Executive Order on Supporting Our Veterans During Their Transition From Uniformed Service to Civilian Life President Donald J. Trump signed this morning (January 9, 2018) to ensure veterans have the resources they need as they transition back to civilian life..

The Executive Order declares, “t is the policy of the United States to support the health and well-being of uniformed service members and veterans.  After serving our Nation, veterans deserve long, fulfilling civilian lives.  Accordingly, our Government must improve mental healthcare and access to suicide prevention resources available to veterans, particularly during the critical 1-year period following the transition from uniformed service to civilian life,

The Executive Order acknowledges the current system fails adequately to care for veterans transitioning to civilian life. It states, “Unfortunately, in some cases within the first year following transition, some veterans can have difficulties reintegrating into civilian life after their military experiences and some tragically take their own lives.  Veterans, in their first year of separation from uniformed service, experience suicide rates approximately two times higher than the overall veteran suicide rate.” To help prevent these tragedies, the Executive Order states all veterans should have seamless access to high-quality mental healthcare and suicide prevention resources as they transition, with an emphasis on the 1-year period following separation.”

In announcing the Executive Order, President Trump said caring for veterans is a “top priority.”

“We want them to get the highest care and the care that they so richly deserve,” he said.

To implement the necessary improvements to improve veterans care, the Executive Order direct the Secretary of Defense, the Secretary of Veterans Affairs, and the Secretary of Homeland Security to collaborate to address the complex challenges faced by our transitioning uniformed service members and veterans to accomplish the following:

Within 60 days, the Secretary of Defense, the Secretary of Veterans Affairs, and the Secretary of Homeland Security must submit to the President, through the Assistant to the President for Domestic Policy, a Joint Action Plan that describes concrete actions to provide, to the extent consistent with law, seamless access to mental health treatment and suicide prevention resources for transitioning uniformed service members in the year following discharge, separation, or retirement.

Within 180 days, the Secretary of Defense, the Secretary of Veterans Affairs, and the Secretary of Homeland Security shall submit to the President, through the Assistant to the President for Domestic Policy, a status report on the implementation of the Joint Action Plan and how the proposed reforms have been effective in improving mental health treatment for all transitioning uniformed service members and veterans that addresses progress on certain specific reforms and any additional reforms that could help further address the problems that obstruct veterans’ access to resources and continuous mental healthcare treatment, including any suggestions for legislative and regulatory reforms; and

A timeline describing next steps and the results anticipated from continued and additional reforms.

The actual Executive Order tells little about how the Trump Administration intends to implement these directives. The White House press release about the Executive Order states President Trump believes that our veterans deserve the best healthcare in the world, and is working with the Department of Veterans Affairs (VA) to expand and modernize their care including through four already announced initiatives to expand healthcare access for our veterans through technological innovation:

An expansion of the VA’s “Anywhere to Anywhere” healthcare, which allows VA providers to use tele-health technology to remotely treat veterans regardless of geographic location.

A greater adoption of VA Video Connect, an application for mobile phones and computers, which directly connects veterans and healthcare providers from anywhere in the country.

At over 100 VA sites across the nation, a rollout of the new Online Scheduling Tool, which enables veterans to schedule appointments from their mobile devices or computers.

A launch of the VA’s “Access and Quality Tool,” which allows veterans to view online both wait times at VA locations and important quality-of-care data.

The press release also states President Trump has ensured continued access to care in the Veterans Choice Program by signing the VA Choice and Quality Employment Act, authorizing $2.1 billion in additional funds for the Veterans Choice Program (VCP).

The VCP gives eligible veterans their choice of private care if they live more than 40 miles from the closest eligible VA facility, experience wait times over 30 days from the clinically indicated date, or face an excessive burden in accessing VA care.

On addition, the press release states the Department of Veterans Affairs will adopt the same Electronic Health Record (EHR) as the Department of Defense (DOD) so all patient data will reside in one common system, enabling the immediate availability of service member’s medical records and seamless care between the departments.

Concerning veterans mental health, President Trump notes that Secretary Shulkin already expanded access to urgent mental healthcare to former service members with other-than-honorable (OTH) discharges.

As in the past, the effect of these promises remains to be seen. The announced changes only provide a portion of the reforms needed and past reform programs have promised much but have failed to resolve access issues and failed to address notorious neglect and abuse recurrently uncovered in many veterans hospitals and other care facilities across the nation. Veterans, their families and treating physicians and others concerned with veterans health issues should monitor proposed changes and provide input as needed to ensure these reforms are properly designed and implemented as well as recommend other improvements.

IRS Guidance Warns About 2017 Deductibility of 2018 Property Taxes In Prepaid In 2017

Taxpayers hoping to preserve and maximize their ability to deduct 2018 state and local property taxes from their income taxes by prepaying those taxes in 2017 before new limitations on the deductibility of state and local property taxes enacted as part of the Job Creation and Tax Reform Act (TRA2017) should verify that the taxes to be prepaid in 2017 should verify that any 2018 tax amounts they plan to prepay actually are both assessed and paid during 2017in light of new Internal Revenue Service (IRS) guidance published on December 27, 2017.

Published on December 27, 2017 in response to questions about the deducibility of prepaid property taxes prompted by new limits on state and local property tax deductions enacted as part of TRA2017 scheduled to take effect in 2018, IR-2017-210  pre-paying 2018 state and local real property taxes in 2017 may be tax deductible only if the pre-paid amounts meet certain conditions.

According to IR-2017-210, whether a taxpayer is allowed a deduction for the prepayment of state or local real property taxes in 2017 generally depends on whether the taxpayer makes the payment in 2017 and the real property taxes are assessed prior to 2018.  IR-2017-210 adds that a prepayment of anticipated real property taxes that have not been assessed prior to 2018 are not deductible in 2017.

According to IR-2017-210, the IRS generally considers a property tax assessedwhen the taxpayer becomes liable for the property tax imposed as determined by state or local law.

IR-2017-210 illustrates these points with the following examples:

Example 1: Assume County A assesses property tax on July 1, 2017 for the period July 1, 2017 – June 30, 2018.  On July 31, 2017, County A sends notices to residents notifying them of the assessment and billing the property tax in two installments with the first installment due Sept. 30, 2017 and the second installment due Jan. 31, 2018.   Assuming taxpayer has paid the first installment in 2017, the taxpayer may choose to pay the second installment on Dec. 31, 2017, and may claim a deduction for this prepayment on the taxpayer’s 2017 return.

Example 2: County B also assesses and bills its residents for property taxes on July 1, 2017, for the period July 1, 2017 – June 30, 2018. County B intends to make the usual assessment in July 2018 for the period July 1, 2018 – June 30, 2019.  However, because county residents wish to prepay their 2018-2019 property taxes in 2017, County B has revised its computer systems to accept prepayment of property taxes for the 2018-2019 property tax year.  Taxpayers who prepay their 2018-2019 property taxes in 2017 will not be allowed to deduct the prepayment on their federal tax returns because the county will not assess the property tax for the 2018-2019 tax year until July 1, 2018.

Accordingly, before prepaying 2018 state and local property taxes in an effort to maximize the federal income tax deductibility of those pre-paid amounts, taxpayers generally will want to check with state and local property tax assessors to confirm that the proposed prepayment amounts are for 2018 property taxes already assessed as well as ensure that the payment is timely made before December 31, 2017.

Obamacare Relief For Some Individuals With Limited Exchange Choices

The Internal Revenue Service is acting to help health Obamacare subsidy eligible individuals living in regions where exchange insurers do not offer bronze (lowest cost) coverage. The move comes as House and Senate Conferees are preparing to conference to work out differences in the tax bill which could repeal the individual Obamacare penalty for failing to maintain coverage while leaving employer penalties against large employers for failing to offer affordable minimum essential coverage.

Notice 2017-74  will provide that Individuals who are not eligible for coverage under an eligible employer-sponsored plan and who lack access to affordable coverage should not be denied the use of the affordability exemption under § 5000A(e)(1) of the Code and § 1.5000A-3(e) of the Regulations merely because they reside in an area served by a Marketplace that does not offer a bronze-level plan.  Consequently, for purposes of the affordability exemption under § 5000A(e)(1) and § 1.5000A-3(e), if an individual resides in a rating area served by a Marketplace that does not offer a bronze plan, the individual generally should use as his or her applicable plan the lowest cost metal-level plan available in the Marketplace serving the rating area in which the individual resides.

Americorps/Senior Corps Join Opiate Addiction Battle

AmeriCorps and Senior Corps are joining the fight against the current epidemic.

The Corporation for National and Community Service, the federal agency for volunteering and service, recently announced it has invested more than $10.5 million in opioid-related AmeriCorps and Senior Corps projects to address the current epidemic.

The federal investment supports 1,200 AmeriCorps and Senior Corps members in more than 150 communities across 45 states.

AmeriCorps and Senior Corps members serve in nonprofits, faith-based, and community organizations working to expand the reach and impact of substance abuse education, prevention, and recovery efforts. They serve as recovery coaches, build capacity for anti-drug organizations, expand drug abuse education, promote the safe disposal of medication, conduct drug screenings and assessments, help prevent relapse and recidivism, and more. CNCS is also providing up to $4.1 million in education scholarships for the AmeriCorps members funded by these grants to help them pay for college, vocational training, or pay back student loans.

The opiate epidemic announcement stems from CNCS’s call to Governor-appointed state service commissions and local and national organizations to use national service as a solution to the growing opioid crisis. Last year, the agency prioritized opioids and substance abuse programming in its funding competitions and program guidance.

For more than two decades, CNCS has supported substance abuse prevention strategies by employing positive youth development through in-school, afterschool, tutoring, and mentoring programs that help youth stay on track, graduate ready for college or career, and refrain from risky behaviors, including illegal drug use.

Quarterly Guidance List Great Tool To Monitor Medicare/Medicaid Program Guidance

Healthcare providers, Medicare/Medicaid Advantage Plans, beneficiaries, and suppliers should use the Medicare and Medicaid Programs; Quarterly Listing of Program Issuances—July Through September 2017 published today to help confirm compliance and other practices take into account potentially relevant new key Medicare and Medicaid guidance issued during the period from July 1 to September 30, 2017.

Staying up-to-date with the latest Program is critical maintain qualification for benefits and rights and avoid getting nailed for harsh civil or even criminal penalties that violations can trigger. However keeping up with the constantly evolving guidance can be daunting.

The quarterly notice lists updates that happened in the 3-month period along with a hyperlink to the full listing that is available on the CMS Web site or the appropriate data registries that are used as Center for Medicare and Medicaid Services resources. for beneficiaries, providers, and suppliers.

Read Text On October 12, 2017 Healthcare Executive Order

President Trump today (October 12, 2017) issued the following that he promised will provide invaluable Obamacare relief  for consumers, employers and others by promoting healthcare choice and competition.

Language of Executive Order

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Section 1. Policy.

(a) It shall be the policy of the executive branch, to the extent consistent with law, to facilitate the purchase of insurance across State lines and the development and operation of a healthcare system that provides high-quality care at affordable prices for the American people. The Patient Protection and Affordable Care Act (PPACA), however, has severely limited the choice of healthcare options available to many Americans and has produced large premium increases in many State individual markets for health insurance. The average exchange premium in the 39 States that are using http://www.healthcare.gov in 2017 is more than double the average overall individual market premium recorded in 2013. The PPACA has also largely failed to provide meaningful choice or competition between insurers, resulting in one-third of America’s counties having only one insurer offering coverage on their applicable government-run exchange in 2017.

(b) Among the myriad areas where current regulations limit choice and competition, my Administration will prioritize three areas for improvement in the near term: association health plans (AHPs), short-term, limited-duration insurance (STLDI), and health reimbursement arrangements (HRAs).

(i) Large employers often are able to obtain better terms on health insurance for their employees than small employers because of their larger pools of insurable individuals across which they can spread risk and administrative costs. Expanding access to AHPs can help small businesses overcome this competitive disadvantage by allowing them to group together to self-insure or purchase large group health insurance. Expanding access to AHPs will also allow more small businesses to avoid many of the PPACA’s costly requirements. Expanding access to AHPs would provide more affordable health insurance options to many Americans, including hourly wage earners, farmers, and the employees of small businesses and entrepreneurs that fuel economic growth.

(ii) STLDI is exempt from the onerous and expensive insurance mandates and regulations included in title I of the PPACA. This can make it an appealing and affordable alternative to government-run exchanges for many people without coverage available to them through their workplaces. The previous administration took steps to restrict access to this market by reducing the allowable coverage period from less than 12 months to less than 3 months and by preventing any extensions selected by the policyholder beyond 3 months of total coverage.

(iii) HRAs are tax-advantaged, account-based arrangements that employers can establish for employees to give employees more flexibility and choices regarding their healthcare. Expanding the flexibility and use of HRAs would provide many Americans, including employees who work at small businesses, with more options for financing their healthcare.

(c) My Administration will also continue to focus on promoting competition in healthcare markets and limiting excessive consolidation throughout the healthcare system. To the extent consistent with law, government rules and guidelines affecting the United States healthcare system should:

(i) expand the availability of and access to alternatives to expensive, mandate-laden PPACA insurance, including AHPs, STLDI, and HRAs;

(ii) re-inject competition into healthcare markets by lowering barriers to entry, limiting excessive consolidation, and preventing abuses of market power; and

(iii) improve access to and the quality of information that Americans need to make informed healthcare decisions, including data about healthcare prices and outcomes, while minimizing reporting burdens on affected plans, providers, or payers.

Sec. 2. Expanded Access to Association Health Plans. Within 60 days of the date of this order, the Secretary of Labor shall consider proposing regulations or revising guidance, consistent with law, to expand access to health coverage by allowing more employers to form AHPs. To the extent permitted by law and supported by sound policy, the Secretary should consider expanding the conditions that satisfy the commonality‑of-interest requirements under current Department of Labor advisory opinions interpreting the definition of an “employer” under section 3(5) of the Employee Retirement Income Security Act of 1974. The Secretary of Labor should also consider ways to promote AHP formation on the basis of common geography or industry.

Sec. 3. Expanded Availability of Short-Term, Limited‑Duration Insurance. Within 60 days of the date of this order, the Secretaries of the Treasury, Labor, and Health and Human Services shall consider proposing regulations or revising guidance, consistent with law, to expand the availability of STLDI. To the extent permitted by law and supported by sound policy, the Secretaries should consider allowing such insurance to cover longer periods and be renewed by the consumer.

Sec. 4. Expanded Availability and Permitted Use of Health Reimbursement Arrangements. Within 120 days of the date of this order, the Secretaries of the Treasury, Labor, and Health and Human Services shall consider proposing regulations or revising guidance, to the extent permitted by law and supported by sound policy, to increase the usability of HRAs, to expand employers’ ability to offer HRAs to their employees, and to allow HRAs to be used in conjunction with nongroup coverage.

Sec. 5. Public Comment. The Secretaries shall consider and evaluate public comments on any regulations proposed under sections 2 through 4 of this order.

Sec. 6. Reports. Within 180 days of the date of this order, and every 2 years thereafter, the Secretary of Health and Human Services, in consultation with the Secretaries of the Treasury and Labor and the Federal Trade Commission, shall provide a report to the President that:

(a) details the extent to which existing State and Federal laws, regulations, guidance, requirements, and policies fail to conform to the policies set forth in section 1 of this order; and

(b) identifies actions that States or the Federal Government could take in furtherance of the policies set forth in section 1 of this order.

Sec. 7. General Provisions. (a) Nothing in this order shall be construed to impair or otherwise affect:

(i) the authority granted by law to an executive department or agency, or the head thereof; or

(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.
